(1 Nov 2016) Dressed in the headscarf and long robe of a devout Muslim, Reema Shamasneh fights for Arab women in the most intimate arena of their lives: Marriage and divorce. In a West Bank divorce court where a woman's testimony is worth half that of a man, she challenges the gender roles at the foundation of Arab families. Women across the Arab world have gained ground in education and health, but inequality remains entrenched in family courts. Under the principles of Sharia, or Islamic law, applied in these courts, women are placed under the guardianship of husbands who must provide for them. While countries such as Tunisia and Morocco have introduced reforms, brides in others must still be represented by male guardians who sign marriage contracts. Men can divorce on a whim, while women must prove cause. And polygamy is legal only for men. Such notions enjoy strong support, even among women. In a 2013 poll by the Pew Research Center, large majorities in seven Arab countries said a woman should obey her husband, from 74 percent in Lebanon to 87 percent in the Palestinian territories and 93 percent in Tunisia. Shamasneh believes the laws are the way they are because they were passed by men. "There is this sort of discrimination in the law, starting from simple things like the marriage contract. The woman must be represented by male guardians who sign the marriage contract and if she has no guardians, in that case, the judge represents her guardians, so at all times she must be represented by male guardians, but the man can represent himself," Shamasneh says. On a typical day, Shamasneh arrives before 9 a.m. at the Islamic courthouse in Ramallah, a 20-minute drive from Qatana, where she lives. Ramallah is the West Bank's most vibrant and liberal city where young women in short sleeves mingle with others in conservative dress in markets and cafes. The court takes up the ground floor of a five-story building, and hearings are held in two small rooms crammed with tables and chairs. Female lawyers and clients wear headscarves when appearing before the judges, in deference to religious traditions. When Shamasneh began practicing 15 years ago, female lawyers were rare. Now the women occasionally outnumber male lawyers in the courthouse. There's even a female judge. Kholoud al-Faqeeh is from Shamasneh's home village, she was a year behind her in law school and received her groundbreaking appointment as Shariah judge in 2009. Al-Faqeeh, a mother of four, occasionally reins in men appearing before her. Still, the judge defends the legal code, with some caveats. She says it reflects gender roles, and women often don't exhaust all legal options, such as stipulating divorce rights in a marriage contract. The growing presence of female lawyers has helped create more empathy for women going through divorce, custody or alimony hearings. Under Shariah, as applied in the Palestinian territories and other parts of the Arab world, a husband can end a marriage by declaring his wife divorced. A wife must prove abuse or neglect in court. In some countries, she can pay the husband compensation to get out of a marriage, in a so-called "khula" divorce. Legal action can take months or years. In recent years, it has become easier for a woman to get a divorce on grounds of abuse, Shamasneh says. A woman still needs to make a compelling case, but it is within the judge's discretion to accept her word without demanding corroborating testimony. Shamasneh occasionally spars with her male colleagues in the lawyers' small waiting room in the courthouse. On one morning, Shamasneh gets into a legal debate with another lawyer, challenging his claim that Islamic law gives the same rights to men and women seeking divorce. The Labor Ministry’s statement added that the new move should adhere to employing female sales assistants in women’s clothing and lingerie shops, which are mainly inside shopping malls. The statement also said: “The decision ensures that the Labor and Social Development Minister sets a time plan for the implementation and designates the location in accordance with the market’s condition and the data of job applicants. Coordination with the Saudization committees in the regions will be carried out with regards to the implementation plans and their dates.” The move comes in line with efforts to cut down the unemployment rate from 11.6 percent to 7 percent by 2030. Saudis make up one-fifth of the number of workers in the retail sector in the Kingdom. According to Vision 2030 released in 2016, there are only 300,000 Saudis out of 1.5 million workers employed in the retail sector. The Kingdom is seeking to create more than 450,000 jobs in the non-governmental sector by 2020, as per the National Transformation Program (NTP) under Saudi Vision 2030. It ‘s the primary source of social progress or regression. Nowhere do we see this more clearly than in the status of women. The Judeo-Christian culture —and perhaps a more apt word is civilization—has produced over time the law codes, language and material prosperity that have greatly elevated women's status. But this progress is not shared everywhere. There are still hundreds of millions of people that live in a culture—the Islamic, for instance—that takes female inferiority for granted. Until recently, these cultures—the Western and the Islamic—were, for the most part, separated. But that is changing. Dramatically so. Large numbers of immigrant men from the Middle East, South Asia and various parts of Africa have brought a different set of values to the West, specifically Europe. More than a million arrived in 2015 alone. More are on the way. As a result, crimes against girls and women—groping, harassments, assaults and rape—have risen sharply. These crimes illustrate the stark difference between the Western culture of the victims and that of the perpetrators. Let me be clear: not all immigrant men, or even most, indulge in sex attacks or approve of such attacks, but it’s a grave mistake to deny that the value system of the attackers is radically different from the value system of the West. In the West women are emancipated and sexually autonomous. Religiosity and sexual behavior or sexual restraint is determined by women's individual wishes. The other value system is one in which women are viewed as either commodities (that is, their worth depends on their virginity), or on the level of a prostitute if they are guilty of public "immodesty" (wearing a short skirt for example). I do not believe these value systems can coexist. The question is which value system will prevail. Unfortunately, this remains an open question. The current situation in Europe is deeply troubling: not only are Muslim women within Europe subject to considerable oppression in many ways, such norms now risk spreading to non-Muslim women who face harassment from Muslim men. One would think that Western feminists in the United States and Europe would be very disturbed by this obvious misogyny. But sadly, with few exceptions, this does not appear to be the case. Common among many Western feminists is a type of moral confusion, in which women are said to be oppressed everywhere and that this oppression, in feminist Eve Ensler's words, is "exactly the same" around the world; in the West just as in Pakistan, Saudi Arabia and Iran. To me, this suggests too much moral relativism and an inadequate understanding of Sharia law. It is true that the situation for women in the West is not perfect, but can anyone truly deny that women enjoy greater freedom and opportunities in the United States, France and Finland than they do in Iran, Pakistan or Saudi Arabia? Other feminists have also argued that non-Western women do not need "saving" and that any suggestion that they "need" help from Western feminists is insulting and condescending to non-Western women. I was frustrated at the beginning but I started to learn not to care about their comments, refusing to listen to what they were saying or to take heed of the words I heard in the streets,” she told euronews. A petrol station in the city has become the first in the country to hire women attendants. Eight girls work during daylight hours. They went through a training course which focused on how to deal with male customers who are usually surprised to be served by a woman. But not everyone filling up is shocked – the girls also get admiring glances especially from women who are impressed to see them there. “My father rejected the idea at the beginning, asking me how I could would work in an open place like this, and why are women working in mens jobs! But when I started, I found it very easy and simple not as my parents had told me, and they became convinced after that,” said one of the girls, Hadeel Ashraf. Om Khada supports her family forging metal. It is a tough job but the only one she could find to earn an income. She has broken through many barriers but believes people now believe in her and she has shown she can be as productive as men. She says her life experience should be a beacon for other Arab women to overcome social and psychological barriers. “It was very strange for many people to see a woman working in such a job and dealing with men in the street, they were asking me why do you work? After some years they started to get used to my work, people started to get to know me very well, I can tell you it’s not a shame at all that a woman works in any kind of job as long as it’s not illegal,” she explained. Euronews correspondent in Cairo Mohammed Shaikhibrahim said: “With these examples which still remain very few and rare in Arab society, Arab women are proving once again their ability to break the restrictions which have been imposed on them But their dreams do not stop at this point, as the gap between reality and ambition to achieve substantial equality is still big.”
